1. Acceptance of Terms
By accessing or using Pixo's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. We reserve the right to update these terms at any time, and your continued use of the service constitutes acceptance of any changes.
2. Description of Services
Pixo provides an AI-powered video creation platform that enables users to generate, edit, and export video content. Our services include text-to-script generation, AI image generation, video synthesis, audio generation, and video editing tools. Service availability and features may vary based on your subscription plan.
3. User Accounts
You must create an account to use our services. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account and keep this information up to date.
4. Acceptable Use Policy
You agree not to use Pixo to create, upload, or distribute content that: (a) is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable; (b) constitutes deepfakes or manipulated media intended to deceive, defraud, or harm individuals; (c) depicts child sexual abuse material (CSAM) or the sexual exploitation of minors; (d) infringes on any third party's intellectual property, privacy, or publicity rights; (e) contains malware, spam, or is used for phishing; (f) impersonates any person or entity without their explicit consent; or (g) violates any applicable law or regulation. We reserve the right to remove any content and suspend or terminate accounts that violate this policy without prior notice.
5. User Content
You retain ownership of any content you create using our platform. By using our services, you grant Pixo a limited license to process your content as necessary to provide our services. You are solely responsible for ensuring your content does not violate any laws or third-party rights.
6. Third-Party AI Models and Services
Pixo integrates AI models and services from third-party providers, including but not limited to ByteDance (Seedance), Kuaishou (Kling), Google (Veo, Imagen), and others. When you use these models through Pixo, your prompts, input media, and generated outputs may be transmitted to and processed by these third-party providers in accordance with their respective terms of service and privacy policies. Pixo does not control the data processing practices of these providers. By using our platform, you acknowledge and consent to this processing. The availability, quality, and capabilities of third-party models may change without notice.
7. Payment Terms
Paid subscriptions are billed in advance on a monthly or annual basis. Credits purchased are non-refundable except as required by law. You authorize us to charge your payment method for all fees incurred. Failure to pay may result in suspension or termination of your account.
8. Intellectual Property
Pixo and its licensors retain all rights to the platform, including all software, algorithms, AI models, and related intellectual property. You may not copy, modify, distribute, or reverse engineer any part of our platform. Generated content is subject to the terms of your subscription plan.
9. Credits, Rate Limits, and Fair Use
Pixo uses a credit-based system to manage access to AI generation features. Credits are consumed based on model, resolution, and duration of each generation. Credit costs are displayed before generation and may be adjusted as we update pricing or add new models. Unused credits do not roll over between billing periods unless otherwise stated in your plan. We enforce rate limits to ensure fair access for all users. Automated, scripted, or bulk usage that exceeds reasonable thresholds may result in temporary throttling or account suspension. Abuse of free credits, including creating multiple accounts to circumvent limits, is prohibited.
10. Indemnification
You agree to indemnify, defend, and hold harmless Pixo, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of our services; (b) content you create, upload, or distribute through our platform; (c) your violation of these Terms; or (d) your violation of any rights of a third party. This indemnification obligation survives the termination of your account.
11. Copyright and DMCA Policy
Pixo respects the intellectual property rights of others. If you believe that content on our platform infringes your copyright, you may submit a takedown notice to our designated DMCA agent at dmca@pixo.video. Your notice must include: (a) identification of the copyrighted work; (b) identification of the infringing material and its location on our platform; (c) your contact information; (d) a statement of good faith belief that the use is unauthorized; and (e) a statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner. We will respond to valid notices in accordance with applicable law and may remove or disable access to infringing content. Repeat infringers may have their accounts terminated.
12. Termination
We may suspend or terminate your account at any time for violation of these terms or for any other reason at our discretion. You may cancel your account at any time through your account settings. Upon termination, your right to use the service ceases immediately.
13. Disclaimer of Warranties
Our services are provided "as is" without warranties of any kind. We do not guarantee that our services will be uninterrupted, error-free, or meet your specific requirements. AI-generated content may contain errors or inaccuracies, and you are responsible for reviewing all output.
14. Limitation of Liability
To the maximum extent permitted by law, Pixo shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.
15. Changes to Terms
We may modify these terms at any time by posting the revised terms on our website. Material changes will be communicated via email or through the platform. Your continued use of our services after such changes constitutes acceptance of the new terms.
